NATSILC: Help For The Alaska SILC

Last week this list serve distributed an item from Patrick Reinhart of 
the Alaska SILC requesting help in providing him with information on how a 
SILC can be housed outside the DSU.  Below are several responses which

Patrick, the Texas SILC is a 501 (c)(3) organization. While our VII B grant
is administered by the VR agency, we are autonomous. The state is in an
upheaval right now and major restructuring is being proposed. At first, the
prevailing bill put independent living centers and services under Long Term
Care, but we have fought that placement. Below is an interpretation of the
Rehab Act relevant to this issue that you may find interesting. It was
provided by the regional office of RSA here in Dallas.

As to whether HHSC could be the designated state agency for purposes of both
Title I and Title VII of The Rehabilitation Act, our research indicates that
based upon The Act, sections 101(a)(2)(A) and (a)(2)(B)(ii), and 34 CFR
sections 361.13(a)(1)(ii) and (b)(1), HHSC could be the designated state
agency
if:

   (1) the State plan is re-written to designate HHSC and to assure that
HHSC includes a vocational rehabilitation bureau, division, or unit that-
(i) is
primarily concerned with vocational rehabilitation or vocational and other
rehabilitation of individuals with disabilities and is responsible for the
administration
of the State agency's vocational rehabilitation program under the State
plan; (ii) has a full-time director; (iii) has a staff, at least 90 percent
of
whom are employed full time on the rehabilitation work of the organizational
unit; and (iv) is located at an organizational level and has an
organizational
status within HHSC comparable to that of other major organizational units of
HHSC; and

   (2) RSA approves the revised State plan.

Patrick,
    I just recently reread a good publication put out by ILRU about "Should
SILCs Become a 501 (c) (3)?" If you contact them I'm sure you can get a copy.
It gives several instances of SILCs that are in different parts of State 
Government. It also said, I believe, that there are 14 states whose SILCs are 
501 (c) (3)s. Let me know how I (or others here in Indiana, but NOT our SILC) 
can help. Give my best to Duane French!
